Join Shiv Martin, a leading conciliation practitioner, trainer and consultant for an engaging virtual session on Conciliation, an evolving area of dispute resolution, particularly in the public service.
As a profession, conciliation is a pathway for many mediators seeking the regular commitment of a dispute resolution role within a statutory or regulatory organisation.
For organisations, conciliation offers an opportunity to resolve conflicts early and informally, harnessing the relationship building benefits of mediation while ensuring the promotion of broader objectives.
Key Learning Objectives
1. Understand the Role and Function of Conciliation in Dispute Resolution
Participants will gain a comprehensive understanding of conciliation as a hybrid dispute resolution process that blends interest-based and rights-based approaches. We will explore how it is distinguished (or not) from other dispute resolution models.
2. Identify the Key Stages and Features of a Conciliation Process
We will explore the overall stages of a conciliation and the common features of a conciliation process, as well as understanding how the process is adapted depending on the context.
3. Evaluate the Different Contexts and Applications of Conciliation
We will examine how conciliation is applied across various sectors, including regulatory bodies, tribunals, and public service settings and discuss the benefits and challenges of using conciliation in these different contexts.
About your trainer
Shiv Martin is a nationally accredited mediator, practicing lawyer, conciliator, and certified vocational trainer with over 15 years of experience in dispute resolution across government, education, and justice sectors. She specialises in conciliation, facilitating complex regulatory disputes, and providing customised training for professionals in conflict management as applicable in particular statutory or regulatory frameworks. She also provides workplace mediation services to a number of public sector clients.
Shiv currently serves as a panel mediator for the Department of Justice (Qld), Conciliator for the Fair Work Commission, an Independent Examiner for the Australian National Contact Point for OECD complaints, and a leading trainer for the Resolution Institute. She has worked with a diverse range of organizations, including government agencies, Commissions, tribunals, and private businesses.
